VISA Consumer Credit Card Agreement


In this agreement, “account” means the credit account regulated by this agreement, “card” means the plastic cards issued under this agreement, including the numbers printed on these plastic cards; “we,” “us” and “our” means MembersAlliance Credit Union (also referred to as MembersAlliance, MACU, and Credit Union); “you” and “your” means anyone who signs an application for this Account or is a guarantor of this Account; and “Approval Letter” means our letter to you approving your application and describing some of the terms of the Account (the “Approval Letter” which is part of the agreement). By signing, using or activating a card, you accept the terms and conditions of this agreement and of the Approval Letter. If any provision of this agreement is determined to be unlawful, the rest of the agreement will stand and the unlawful provision will be deemed amended to conform to applicable law. All cards are our property; they are not transferable and must be returned to us immediately upon demand. We may cancel the card and revoke privileges at any time without prior notice.

  1. Your Credit Card: By using your MembersAlliance credit card, you acknowledge receipt of the Credit Card Agreement and Credit Card Account Opening Disclosure and you agree to terms and conditions contained within each. You may use your card to make purchases from merchants, obtain cash advances, and may be used at some ATM machines with the use of a personal identification number (PIN). You agree that you will not use your card for any transaction that is illegal under local, state and federal laws. If you use your card for illegal transactions, you will be responsible for all corresponding charges and amounts.
  2. Credit Limit: Your credit limit is stated in the disclosure attached to your Approval Letter and on your monthly statement. The credit limit is the maximum amount of purchases, cash advances, fees, interest charges, etc which can be outstanding at any time. You agree not to exceed your credit limit. We can change your credit limit at any time to any amount. We will state the new credit limit on your next monthly statement.
  3. Annual Percentage Rate (APR): Your APR is based on your creditworthiness at the time of account opening. The APR is stated in the disclosure attached to your Approval Letter and on your monthly statement.
  4. Promise to Pay: You agree to pay us the total amount of purchases, cash advances, interest charges, balance transfers, fees, etc., which arise from the use of the card by you or anyone you authorize to use your account.
  5. Joint Accounts: If your account is a joint account, all persons listed will be individually and jointly responsible for paying all amounts, charges, and fees incurred, which arise from use of the card by any of the holders. All persons on a joint account authorize all other joint holders to make purchases or cash advances. We could require any one of the joint holders or all of them to repay the entire amount owed. If the jointly held credit card is terminated by one of the individuals, it is terminated for all individuals listed.
  6. Interest Charges: Interest charges will not be incurred for new purchases posted to your account during a billing cycle if you had a zero or credit balance at the beginning of that billing cycle, or you paid the entire new balance on the previous cycle’s billing statement by the payment due date of that statement. If the previous is not applicable, a interest charge will accrue from the date a purchase is posted to your account. In order to avoid additional interest charges on purchases, you must pay the entire new balance on the billing statement by the payment due date of that statement. Cash advances posted to your account will begin to accrue interest charges on the transaction date.
  7. Foreign Transactions: All purchases and cash advances made in a foreign denomination will be charged to your account in U. S. dollars. The exchange rate to convert the currency to U.S. dollars is a government-mandated exchange or other wholesale exchange rate determined by VISA. This rate may vary from transaction to transaction. VISA may charge you a foreign currency conversion fee of up to 1%. Foreign transaction fees are calculated based on the transaction amount.
  8. Payments: You agree to make the minimum monthly payments as documented on your statement by the date documented on the statement. The payment must be in U.S. dollars drawn on a U.S. Financial Institution. You may make more than one payment, pay more than the minimum payment, or pay the total new balance in full. The minimum payment is 2% of your total new balance or $25.00, whichever is greater, plus the amount of any prior minimum payments that you have not made, and any amount you are over your credit limit. MACU has the right to demand immediate payment of any amount by which you are over your credit limit.
  9. Payment Allocation: Your payments will be applied first to the balance with the highest annual percentage rate and then to the next highest annual percentage rate until the principal balance is paid in full. We may accept late payments, partial payments, post-dated checks, or any form of payment containing a restrictive endorsement, without losing any of our rights under this agreement. Our acceptance of checks or money orders labeled “payment in full” or words to that effect, will not constitute an accord and satisfaction or a waiver of any rights we have to receive full payment.
  10. Balance Computation Method: We figure the interest charge on your account by applying the periodic rate, as stated in your disclosure provided with the Approval Letter, to the “average daily balance” of your account. To get the “average daily balance” we take the beginning balance of your account each day, add any new purchases/advances/fees, and subtract any unpaid interest or other interest charges and any payments or credits. This gives us the daily balance. Then, we add up all the daily balances for the billing cycle and divide the total by the number of days in the billing cycle. This gives us the “average daily balance.”
  11. Monthly Statements: We will send you a statement at the end of each billing cycle in which the account has a balance. The statements will be deemed correct and accepted by you and all holders of the card, unless we are notified to the contrary in writing within 60 days of mailing of such statement. The due date for your payment will be 25 days after the last day covered by the statement. Statements, notices, and credit cards will be mailed to you at the address you have provided to us. If the Account is in the name of more than one person (i.e. joint), notices mailed to any one of the persons on the account will be considered as sending notice to all.
  12. Credit Information: You authorize us to investigate your credit standing when opening, renewing or reviewing your account, and you authorize us to disclose information regarding your Account to credit bureaus and other creditors who may inquire of us about your credit standing.
  13. Security Interest: You grant the Credit Union a security interest in all deposit accounts you have or may acquire, individually or jointly. If you are in default, you authorize the Credit Union to withdraw funds from your non-IRA accounts to pay any amounts due. Under the Uniform Commercial Code and under any other common law rights, you give MACU a security interest in all goods you purchase. If you pledge shares by signing a separate pledge of shares agreement, you may not withdrawal those funds until we release them. You agree that collateral securing all current and future loans, with the exception of household goods or mortgage, will also secure your obligations under this agreement.
  14. Telephone Communications: You agree that we or our agents or service companies may monitor and/or record any telephone communications with you.
  15. Default: You will be in default if you fail to make any minimum payment or other required payment by the date that it is due. You will be in default if you violate any other provisions of this agreement and such violation materially impairs the prospect of you paying the amount due on the account. Upon default, we may demand immediate payment of the entire amount due on the account and we may enforce our right to this payment as permitted by law. You agree to pay all costs incurred by the Credit Union in collecting your indebtedness or in enforcing this agreement, including reasonable attorney’s fees and also those costs, expenses and attorney’s fees incurred in appellate, bankruptcy and post-judgment proceedings, except to the extent such costs, fees or expenses are prohibited by law.
  16. Fees: Fees will be charged for late payments, returned checks, document copies, research time, rush fees, bad addresses, etc. Please refer to the disclosure which accompanied the Approval Letter for the actual amounts charged.
  17. Lost or Stolen Notification: You agree to notify us immediately if your Card is lost or stolen by calling us 1-800-234-5354 (available 24 hours a day) or by writing to us at VISA, PO Box 10409, Des Moines, IA 50306.
  18. Liability for Unauthorized Use: You may be liable for the unauthorized use of your Card, whether due to loss or theft of a Card or another reason. You will not be liable for unauthorized use that occurs after you notify us orally by calling 1-800-234-5354 or you notify us in writing by mailing the notice to VISA, P.O. Box 10409, Des Moines, IA 50306. In any case, your liability will not exceed $50.
  19. VISA U.S.A. Inc.: You agree that the Account shall be subject to all applicable rules and regulations of VISA U.S.A. Inc and laws. If there are any conflicts between the provisions of this Agreement and the rules and regulations of VISA U.S.A. Inc., VISA U.S.A. Inc. shall control.
  20. Governing Laws: Except to the extent that Federal law is applicable, the validity, construction and enforcement of this Agreement and all matters arising out of the issuance and use of the credit card shall be governed by the laws of the state of Illinois.
  21. Enforcement of Rights: We may choose not to enforce some of our rights at anytime with out losing them.
  22. Amendments: We may amend the terms of this Agreement and Disclosures at any time as permitted by law. You will receive notice of any change in accordance with corresponding laws. The notice will be mailed to your last known address.
  23. Terminating Your Account: This Agreement may be terminated by you or the Credit Union at any time. You may terminate this Account by notifying us in writing. The notice can be mailed to the VISA Department, 2550 South Alpine Road, Rockford, IL 61108. You will be responsible for all transactions and interest charges made to your account, unless the transactions were unauthorized.

What To Do If You Find A Mistake On Your Statement

If you think there is an error on your statement, write to us at:

In your letter, give us the following information:

  • Account Information: Your name and account number.
  • Dollar Amount: The dollar amount of the suspected error.
  • Description of Problem: If you think there is an error on your bill, describe what you believe is wrong and why you believe it is a mistake.


You must contact us:

  • Within 60 days after the error appeared on your statement.
  • At least 3 business days before an automated payment is scheduled, if you want to stop payment on the amount you think is wrong.

You must notify us of any potential errors in writing [or electronically]. You may call us, but if you do we are not required to investigate any potential errors and you may have to pay the amount in question.


What Will Happen After We Receive Your Letter


When we receive your letter, we must do two things:

  • Within 30 days of receiving your letter, we must tell you that we received your letter. We will also tell you if we have already corrected the error.
  • Within 90 days of receiving your letter, we must either correct the error or explain why we believe the bill was correct.

While we investigate whether or not there has been an error:

  • We cannot try to collect the amount in question, or report you as delinquent on that amount.
  • The charge in question may remain on your statement, and we may continue to charge you interest on that amount.
  • While you do not have to pay the amount in question, you are responsible for the remainder of your balance.
  • We can apply any unpaid amount against your credit limit.

After we finish our investigation, one of two things will happen:

  • If we made a mistake: You will not have to pay the amount in question or any interest or other fees related to that amount.
  • If we do not believe there was a mistake: You will have to pay the amount in question, along with applicable interest and fees. We will send you a statement of the amount you owe and the date payment is due. We may then report you as delinquent if you do not pay the amount we think you owe.

If you receive our explanation but still believe your bill is wrong, you must write to us within 10 days telling us that you still refuse to pay. If you do so, we cannot report you as delinquent without also reporting that you are questioning you bill. We must tell you the name of anyone to whom we reported you as delinquent, and we must let those organizations know when the matter has been settled between us.

If we do not follow all of the rules above, you do not have to pay the first $50 of the amount you question even if your bill is correct.


Your Rights If You Are Dissatisfied With Your Credit Card Purchases


If you are dissatisfied with the goods or services that you have purchased with your credit card and you have tried in good faith to correct the problem with the merchant, you may have the right not to pay the remaining amount due on the purchase.
To use this right, all the following must be true:

  1. The purchase must have been made in your home state within 100 miles of your current mailing address and the purchase price must have been more than $50. (Note: Neither of these are necessary if your purchase was based on advertisement we mailed to you, or if we own the company that sold you the goods or services.)
  2. You must have used your credit card for the purchase. Purchases made with cash advances from an ATM or with a check that accesses your credit card account do not qualify.
  3. You must not yet have fully paid for the purchase.

While we investigate, the same rules apply to the disputed amount as discussed above. After we finish our investigation, we will tell you our decision. At that point, if we think you owe an amount and you do not pay, we may report you as delinquent.
